The probate litigation attorneys of Barron, Rosenberg, Mayoras & Mayoras, P.C. represent heirs, beneficiaries, and personal representatives in disputes concerning the terms of contested wills. To learn more about our ability to help resolve a disagreement about the effect of a decedent's will in your family, contact one of our lawyers in Troy.
A last will and testament is the most common means of assuring that a person's preferences as to the distribution of assets among his or her heirs and other beneficiaries will be effectuated. In many situations, however, legitimate questions can arise as to whether the testator's mental capacity at the time of the execution of the will was sufficient to understand the consequences of the terms of the will. In other situations, another person may have had an undue influence on the person executing the will. Also, heirs such as adult children from a previous marriage might resent changes in a revised will that favor a new spouse to their own disadvantage. In these situations, we will try to resolve your case diplomatically. However, when diplomacy has failed and you cannot afford to lose, our attorneys will aggressively litigate your position and fight for you in court.
The probate attorneys at our firm have experience with the analysis and litigation of contested wills under Michigan law. We know how to consider questions and present evidence concerning the testator's competence, allegations of undue influence or fraud, and when to invoke rights of intestate succession as an alternative to taking under the terms of a will. Our experience with contested will issues of all kinds can not only help protect your interests as an heir or fiduciary of the estate, but can also help promote the resolution of will contests on terms that will ease tensions and hard feeling between opposing family factions.
Our lawyers also represent parties in probate disputes regarding the construction of a will. These actions do not seek the invalidation of a will, but instead focus on problems of interpretation of particular terms that can affect the rights of an heir or devisee.
We can advise and represent anyone with an interest in a Michigan estate, either as an heir or personal representative, in metro Detroit or throughout the state. We also represent clients from out of state who need advice about their rights under a contested Michigan will.
